Recent Firm Victory:
The United States District Court for the Middle District of North Carolina denied a motion for summary judgment in an ADA case. Plaintiff Jana Churchwell alleged that she was terminated due to her disability and was not provided a reasonable accommodation by the City of Concord, North Carolina. On June 11, 2018, the Court issued a Memorandum and Order denying Defendant’s motion finding that Churchwell submitted sufficient evidence that she was discriminated against due to her disabiity and that she had been denied a reasonable accommodation as required by the ADA as amended by the ADAAA. This decision clears the way for Churchwell case to be heard by a federal jury in late fall 2018.
