Decision by EEOC AJ reversed on appeal. Complainant was employed by a federal contractor whose contract was with the US Marshall’s Service.
Complainant alleged that he was subjected to inappropriate medical inquiries and examinations. After filing a request for a hearing, an EEOC Administrative Judge (AJ) issued a decision without a hearing also called a motion for summary judgment. Thereafter the Agency issue a Final Agency Decision implementing the AJ’s decision. On appeal, the Office of Federal Operations reversed and remand back to the Agency for processing.
