Federal employee alleged discrimination based on race, sex, disability, age and retaliation. Complainant, a federal employee, worked as an RN for the Department of Veteran’s Affairs (VA).

He filed an EEO complaint alleging that the agency had discriminated. The complaint included allegations of race, sex, disability and age discrimination. It also included an allegation of retaliation. The administrative judge dismissed the complaint because the complainant had filed a different civil action on the same claims.  The civil claim was dismissed filed an appeal, since the civil case was no longer an issue. However, EEOC determined that he had no basis to pursue his claims. The dismissal was affirmed.
