Federal employee appeals MSPB decision and wins. Cyril D. Oram, a federal employee, was terminated from his position with the U.S. Census Bureau. He appealed to the Merit Systems Protection Board (MSPB) in May of 2020. He alleged the Census Bureau denied him benefits due to his prior military service. His claim was brought under the Uniformed Services Employment and Reemployment Rights Act (USERRA). The MSPB dismissed Mr. Oram’s claim for lack of jurisdiction. Mr. Oram appealed the MSPB decision to the United States Court of Appeals for the Federal Circuit for Review. The Court vacated the MSPB’s dismissal and remanded.
