Federal employee wins appeal of EEOC decision dismissing her case. Complainant was employed by the Department of the Navy.She reported her pregnancy to the Agency and requested an accommodation. The Agency denied the accommodation. Complainant alleged that she was forced to take unpaid leave and ultimately resign her position due to the Agency actions. After filing with the EEOC, the Agency moved for summary judgment. The EEOC AJ assigned to the case issued a decision granting summary judgment (a decision without a hearing). The Complainant appealed the decision.

The EEOC’s Office of Federal Operations (OFO) reversed. It also remanded the case back to the EEOC office for a hearing and ordered that a different AJ handle further proceedings.
