The North Carolina Human Resource Act (formerly the North Carolina State Personnel Act) provides that employees who are in permanent positions with permanent assignments and who have worked at least 12 months are, with a few exceptions, protected from certain personnel actions unless there is “just cause” for the action. (N.C.G.S. Chapter 126). If you are such an employee, your agency can terminate you only with “just cause.”  However, you must challenge the decision by filing a petition for a contested case with the North Carolina Office of Administrative Hearings.  The petition must be filed within 30 days of receipt of the final agency decision.
