USPS employee wins EEOC appeal. Complainant filed an EEO alleging disability discrimination and reprisal. After the investigation, Complainant did not request an EEOC hearing so the USPS issues a Final Agency Decision (FAD) in its own favor finding no discrimination or reprisal. Complainant appealed. The EEOC’s Office of Federal Operations reversed the Agency’s FAD. It found that Agency denied Complainant a reasonable accommodation for his hearing disability. Specifically, it did not provide a sign language interpreter during training and safety meetings. Since the physical safety of employees in the workplace is the subject of discussion, it is uniquely pressing for Complainant to have access to the information being conveyed.
